Terms of Service

THIS IS OUR REFUND AND CANCELLATION POLICY. BY HIRING STUDIO SALUD FOR SERVICES YOU ARE BOUND BY THIS AGREEMENT AND YOU AGREE TO ABIDE BY MY POLICIES.

At Studio Salud every project is important to me and I make sure that I handle each client’s needs with utmost care and professionalism. My aim is to provide the results as per the terms and conditions of the proposal. However, despite every measure, if the client is not satisfied with the results and chooses to go for the dispute resolution process, I consider refund requests as per the following program in which my services and refund policy related to each service is very clearly listed:

-Website

-Web/Graphic/Logo design

-Copywriting

-Consulting

-Branding

-Delivery Time

  • Partial refund: If there is a failure to deliver as per my delivery policy after the approval of the initial design style. The partial refund will be in proportion to the work completed based on an hourly rate of $75/hr.

  • No refunds: If the project has been completed and uploaded on the server.

Applicability of the Delivery Policy

NOTE: Studio Salud’s delivery commitment is subject to:

  • A project is not taken to be void unless the agreed-upon payments are clear.

  • Refund policy is not applicable if the required information for the successful completion of the project is not provided in a timely manner. If there is a delay or failure in completion of the project due to improper communication from the client, it cannot be attributed to Studio Salud.

  • If the information provided by the client is incomplete and/or complete information regarding the project is not provided at the initiation of the project, Studio Salud is not liable to follow its delivery or refund commitments.

  • There is no provision for compensation for the delay of delivery under any conditions, until and unless there is an agreement signed with a penalty clause for delay in delivery.

  • All contracted services (logo design, web design, graphic design, copywriting) are limited to three rounds of revisions. Any additional revisions will be moved to my hourly rate of $75/hour.

  • Failure to maintain contact or respond to inquires by Studio Salud (via email, text, call, messaging platforms, etc.) for a period of 14 days or more results in contract cancellation. This pertains only to contract abandonment on the Client’s part. If the Client wishes to proceed with abandoned projects, a new contract and invoice will be distributed with all former contracts being void and deposits forgone.

Limitation of Liability

Studio Salud is not obligated for losses due to the services provided/not provided or the delay in the same at any point of time. The liability to refund holds only if the project has been canceled by the client and such cancellation has been communicated to Studio Salud in writing.

Processing of Refunds

The partial refunds will be processed within 90 business days of the date of cancellation and will be brought about using the method of payment agreed upon in the beginning of the project.

Full refunds will be processed within 90 business days of the date of cancellation and will be brought about using the method of payment agreed upon in the beginning of the project.

Cancellation

Projects that are canceled at least 30 days prior to the start date may be rescheduled at the end of my queue. Cancellations made less than 30 days from the project start date result in full loss of deposit and may be rescheduled only with payment of another deposit.

Studio Salud reserves the right to terminate any contract with/without cause under any circumstance resulting in the client’s forfeiture of any prior deposits made.

Projects canceled by either the client or Studio Salud result in the forbidden use of any files or work completed. Files uploaded by the client without successful completion of this agreement will result in a cease and desist.

Payments

  • Acceptable payment methods are Zelle, Venmo, PayPal, CashApp, Credit/Debit Card

  • You will be sent an invoice from Studio Salud

  • A 50% non-refundable deposit is required before we begin on a project. We do not issue refunds for fees paid in advance. Once a payment or deposit is made, it is non-refundable. All Setup fees are nonrefundable as it is applied to costs immediately incurred in initiating services. If a project is canceled or postponed, all monies paid are retained by Studio Salud and if applicable, a fee for all work completed beyond what was already paid for shall be paid by the client.

  • The remaining balance will be invoiced before completion of the job.

  • Original files/completed site development will not be issued until the full balance has been paid.

  • Additional charges (for site builds) will be applied if the client needs additional work that is outside of the original quote or package specifications.

  • Client has 5 days to make their final payment or a $100 late fee will be applied for every week that the client is late after that time.

Project Timeline

I do not guarantee a completion date for any project. Most blog/web design projects can be completed in 3-4 weeks. This usually depends on the speed of the client’s feedback and the number of revisions required. If you have a project deadline, please let me know – I do keep clients in order of first come – first serve. If you are in a hurry and need something done within a week, we offer a special “Rush” pricing – you can read more about that below.

Rush Jobs

If you are in a rush and need a project completed right away, I offer special “rush rates” where I can promise that your project would be moved to the front of the line and done within a 7-day time frame. You would be charged an additional 50% on the total. i.e. if the project is normally $100, with the rush fee, the project would total $150. 

Design Process

  • You will be required to fill out a detailed design questionnaire, which will help me identify your needs.

  • You will be required to create an inspiration board via Pinterest.

  • Studio Salud will create a design and/or wireframe using the One Concept Method.

  • The initial estimated time frame will be extended if it is difficult to contact you during the design process.

  • If feedback from completed work is not responded to within five business days, the work will then be considered “complete” and next project phases will begin and/or billing will be sent as required.

  • We provide an estimated price breakdown once we receive your completed questionnaire. Prices are subject to change.

Kill Fee

A “kill-fee” or project abandonment fee of $500, by the Client, will result in the forfeiter of any design assets and written assets, as well as the forfeiter of the 50% retainer on the Client’s part. This Kill Fee will take effect in circumstances in which:

  • The Client does not provide verbal or written documentation (in form of text, social media messaging, email, etc) for a period of 14-days or more to the Designer.

  • The Client starts a project with the Designer and does not complete the project, preventing the Design to take on or allocate time to other clients.

This fee is non-negotiable and will be billed accordingly, with the same late fees being applied if the Kill Fee remains unpaid. 

Purchasing Merchandise

We offer full returns within 30 days of purchase any for-profit items. Not-for-profit items can not be returned or exchanged under any circumstance.

Changes

Studio Salud may at any time, without prior notice under its sole discretion, amend this policy from time to time. You are therefore requested to review this policy periodically. Your continued use of Studio Salud website after any such amendments automatically implies your acceptance of the same thereof.
